Terms of Service

These Terms of Service apply when you use whisperwoods.co.nz or purchase products from Whisperwoods. In these terms, “we”, “us” and “our” mean Whisperwoods, and “you” means the customer or website user.

1. Consumer rights

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986.

2. Products and handmade variation

We aim to describe and photograph products accurately. Screens, lighting and the handmade nature of ceramic and painted products can result in reasonable differences in colour, texture, brushwork, glaze and placement. These natural variations are not faults unless the product materially differs from what was agreed or fails an applicable consumer guarantee.

3. Custom and personalised orders

You are responsible for providing clear, lawful and accurate photos, names, dates, wording, size selections and other instructions. We may contact you for clarification before production. Production time may be extended while we wait for your response.

You confirm that you have permission to provide any photographs, names, artwork or other material submitted for your order. You grant us and our production partners a limited licence to use that material only as reasonably necessary to create, quality-check and deliver your order. We will not use customer photographs for advertising without separate permission.

4. Orders and acceptance

Submitting an order is an offer to purchase. We may decline or cancel an order before acceptance where a product is unavailable, pricing is clearly incorrect, supplied material is unlawful or unsuitable, or we cannot reasonably complete the requested customisation. If we cancel after payment, we will refund the affected amount.

5. Prices and payment

Prices are displayed in the currency selected for the applicable market. Delivery charges, taxes or other amounts collected by us will be shown before checkout is completed. Payment must be authorised before an order is processed.

6. Cancellations, returns and refunds

Cancellations, returns and refunds are governed by our Return and Refund Policy, together with your rights under applicable law.

7. Shipping and delivery

Production and delivery estimates are explained in our Shipping Policy. Estimates are not guaranteed, but we remain responsible for meeting our legal delivery obligations and assisting when an order is materially delayed, lost or damaged.

8. Website use

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with checkout or security, scrape the website in a way that causes harm, or use the website for unlawful activity.

9. Intellectual property

Unless otherwise stated, the website's branding, layout, original text, graphics and original product imagery are owned by or licensed to Whisperwoods. You may use the website for personal shopping purposes but may not reproduce or commercially exploit our content without permission.

10. Third-party services

Our store is hosted by Shopify and may use payment providers, couriers, review services and other service providers. Their services may be subject to their own terms and privacy notices.

11. Liability

To the maximum extent permitted by law, we are not liable for losses that are indirect, unforeseeable, caused by your misuse of a product, or caused by information or instructions you supplied incorrectly. This does not limit liability or remedies that cannot lawfully be limited.

12. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time. The terms displayed when you place an order will apply to that order, except where a later change is required by law or agreed with you.

14. Governing law

These terms are governed by New Zealand law. Any dispute may be brought before a New Zealand court or tribunal with jurisdiction, without limiting rights under mandatory laws that apply where you live.
